Come Fly With Metal Sky High.

1. Nature of the Activity and Voluntary Participation

This agreement is between the passenger or participant signing below ("Participant") and Metal Sky High Powered Paragliding School LLC ("Metal Sky High"), together with its owners, instructors, tandem pilots, employees, agents, contractors, equipment owners, and affiliated persons.

I understand that tandem powered paragliding / paramotor flight is an aviation activity involving a paraglider wing, powered aircraft or paramotor/trike equipment, a pilot or instructor, launch, flight, maneuvering, approach, and landing. I am voluntarily choosing to participate as a tandem passenger and understand that participation is not required.

I understand that Metal Sky High may refuse, delay, reschedule, modify, or terminate a flight or related activity whenever the pilot or instructor believes weather, equipment, site conditions, passenger condition, air traffic, or any other factor makes participation unsafe or inappropriate.

2. Acknowledgment and Assumption of Risk

I understand that powered paragliding and paramotor flight involve inherent and other risks that cannot be eliminated, even when reasonable care is used. Risks include, but are not limited to: equipment malfunction or failure; unexpected wind or weather changes; turbulence; hard, fast, or off-field landings; launch or landing incidents; collision with terrain, obstacles, vehicles, aircraft, people, or objects; pilot or participant error; actions of third parties; air traffic; fire; propeller hazards; and other known or unknown conditions associated with aviation and outdoor activities.

Possible injuries include bruises, sprains, fractures, head or spinal injury, paralysis, permanent disability, emotional distress, property damage, and death. I understand that serious injury or death can occur even when instructions are followed and equipment functions as intended.

I knowingly and voluntarily accept and assume all risks of participating, whether known or unknown, including risks arising from my own acts or omissions, the acts or omissions of others, equipment, weather, terrain, or the ordinary negligence of Metal Sky High or its Released Parties, to the fullest extent permitted by applicable law.

3. Passenger Responsibilities and Safety Instructions

I agree to follow all instructions given by the tandem pilot or instructor before, during, and after the activity, including instructions concerning seating, harnesses, restraint systems, body position, launch, landing, emergency procedures, and movement around propellers or operating equipment.

I agree not to touch controls, equipment, lines, propellers, or other components unless specifically instructed to do so. If I am permitted to make control inputs, I understand that the pilot or instructor remains in command and may immediately take full control.

I will not participate while impaired by alcohol, recreational drugs, or any substance that could affect judgment, coordination, balance, or ability to follow instructions. I will promptly disclose any condition or limitation that could materially affect safe participation.

I understand that the tandem pilot has final authority regarding whether a flight occurs and how it is conducted. I agree not to pressure or persuade the pilot to fly when the pilot considers conditions unsuitable.

4. Release of Liability and Covenant Not to Sue

In consideration of being allowed to participate, I RELEASE, WAIVE, AND DISCHARGE Metal Sky High and its owners, instructors, tandem pilots, employees, agents, contractors, equipment owners, and affiliated persons (collectively, the "Released Parties") from claims or causes of action for personal injury, death, property damage, or other loss arising out of or related to my participation.

This release is intended to include claims arising from the ordinary negligence of a Released Party to the fullest extent permitted by law. It does not waive any right or claim that cannot legally be waived.

I agree not to bring or maintain a lawsuit or other claim against a Released Party for matters covered by this agreement.

5. Indemnification and Hold Harmless

To the fullest extent permitted by law, I agree to indemnify and hold harmless the Released Parties from claims, demands, liabilities, damages, judgments, or reasonable legal costs arising from my own conduct, my breach of this agreement, or claims brought by or through me that are covered by this release.

I understand that this provision is intended to apply to claims connected with tandem flight, ground handling, equipment use, transportation related to the activity, launch and landing operations, and other directly related activities.

6. Health, Fitness, and Emergency Care

I represent that I am physically and mentally capable of participating, or that I have disclosed any relevant limitation to Metal Sky High before the activity. I understand that Metal Sky High does not provide a medical examination and does not guarantee that I am medically fit for flight.

If an emergency occurs and I am unable to provide consent, I authorize reasonable emergency assistance and medical care. I understand that I am responsible for costs of medical treatment, transportation, or rescue unless otherwise required by law.

7. Weather, Scheduling, Cancellation, and Flight Conditions

I understand that tandem flights are highly weather dependent. A requested or scheduled date and time may be delayed, changed, or rescheduled because of wind, precipitation, visibility, air traffic, field conditions, equipment concerns, or other safety considerations.

Payment or placement in a scheduling queue does not guarantee that a flight will occur on a particular date or at a particular time. The final go / no-go decision belongs to the tandem pilot or instructor.

8. Equipment and No Warranty of Safety

I understand that no aircraft, paraglider, paramotor, trike, harness, reserve parachute, helmet, communication device, or other equipment can eliminate all risks. Inspection, maintenance, training, and safety practices may reduce risk but do not make powered paragliding risk-free.

9. Severability, Entire Agreement, and Michigan Law

I intend this agreement to be interpreted as broadly as permitted by applicable law. If any provision is found invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

I understand that this document contains the terms of my release and assumption of risk relating to the activities described above. I am not relying on any oral statement that contradicts this written agreement.

This agreement is intended to be governed by applicable Michigan law to the fullest extent permitted by law.

Optional Media Permission

This choice is separate from the liability waiver and is not a condition of participating.

Final Electronic Acknowledgment

I confirm that I have read this entire agreement, understand it, have had the opportunity to ask questions, and am signing voluntarily. I understand that by signing I am giving up substantial legal rights, including certain rights to bring claims against the Released Parties.

I am the parent or legal guardian of the minor Participant named above. I consent to the minor’s participation and agree, on behalf of myself and to the extent permitted by law on behalf of the minor, to the assumption of risk, release, indemnification, and other terms of this agreement.

This electronic signature is recorded with the completed booking. Metal Sky High should have its waiver language reviewed periodically by its attorney and insurance provider.
